Prior Approval (Class MA)
Own a property under current Class E Use (Commerical, Business and Services? Then we can advise how you can convert into Flats Use Class C3 without planning permission.
Prior Approval (Class MA) can sometimes be confused for change of use under permitted development and hence, without the need for an application to the local authority, but this isn’t that case. You will still require plans and information submitted to the council for approval but its much less than a standard application.

These are the most common question we get from landlords or developers when wanting to convert a property into flats. If you can’t find your question below feel free to contact us, and we’ll be happy to help.
Will I have to split the Gas/Water/Electric?
Yes, each flat will need its own separate units and meter. They are usually split at the property and either located externally via white or brown boxes (not always the best looking) or more commonly, inside the property in a small plant room.
Do you have your own trusted builders?
Yes. We can provide you with our own design and build quote as a one stop solution. So no need to worry about doing all the leg work. We have got you covered.
Can I split my home into flats?
This will depend on your house size (likely 2 flats). It is easier to do this if the loft is converted or can be used as a habitable space and the property has a good size footprint. Older Victorian or Edwardian properties have ideal layouts for flat conversions. The National Space Standards set out the sizes for flats. For 1 person, 1 bedroom 37sqm can be achieved. It helps to have some form of shared access to the garden so the flats can have shared amenity space, along with Bin storage.
Does each flat need a parking space?
This will depend on which council you are submitting too. We would always recommend to aim for at least one parking space per flat if you can manage this. If your property is close to city or town centres however, there might be some flexibility with planning approval. A top tip would be to think about visibility splays and turning heads. Highways commonly refuse applications if there isn’t safe access and egress to the parking areas.
Can I convert without planning permission?
Yes, you can. In short, as long as your property falls under Use Class E, is vacant (over 3 months) and can provide some parking for residents you can submit a prior approval application under Class MA permitted development order. Take a look at our guide for all of the details.
Do I need to upgrade my walls?
We would recommend that you do. This will be likely with a insulated plasterboard or a timber batten on damp proof strips with superquilt detail. However, if you keep the existing plaster on the walls you wont need to upgrade. 0.3 U value is to be achieved should you upgrade.
How much do you charge for Flat conversions?
This will depend on your property, of course, and if you need building regulations as well as planning drawings. A good rule of thumb is about 3-10% of the construction price. Smaller flat conversions can be as low as £1,000 (plus VAT). The best thing to do is get in touch with us and we can tailor the quote for your project.
How long will planning take?
8 weeks. However, we say it can be up to 10-12 weeks due to validation time and sometimes planning officers may ask for an extension of time for the decision date. 56 days if you have submitted under Prior Approval (Class MA) change of use.
Is it better to use private or councils building control?
We recommend you use private building control inspectors because your not always sure if who you will get appointed from the council. As of 2024, all of the building control officers in the UK where required to be independently checked and verified as RBI.
